Can I Still Counter If The Seller Has Accepted Another ... - Realtor.com

Q: I recently was going through the offer/counter offer process on property. The realtor reached out to my attorney/me told us they accepted another offer. Even though, they have accepted the offer, am I still able to make an offer on this property? I really like this property and very upset on how this realtor has been through this entire process. Some of the things that took place during this whole process in my opinion have been very unprofessional. Is it ok for a realtor to continue to contact you even after you tell them to work directly with your attorney? Call/text at 1020pm? Call/text 3-4x/day week/weekend? Any advice or feedback on this whole situation would be great! Thanks!

A: The answer to your first question is, yes, you can still make an offer on the property. If accepted, it would be a backup offer and would only take effect if the first offer is terminated. Your attorney can draft the offer with the necessary provisions.

The answer to your second question is that it is not OK for a Realtor to continue to contact you if you have told them to work directly through your attorney or other agent. You can bring this to the attention of the Realtor?s managing broker. If that does not resolve the problem, you can file an ethics complaint with the local association of Realtors or even with your state?s division of real estate.

A: State laws differ so it?s hard to address your issue on that basis. If another offer was accepted over yours, then ask if you can submit a back-up offer, should the accepted offer fall through. As for your Realtor, you may want to have a conversation with him/her and re-state your instructions: call my attorney directly. Or, on future offers, if your doubts persist and you haven?t signed a Buyer?s Agent agreement, find another Realtor, one whom you will be comfortable with.
